TERMS & CONDITIONS
1 General and Rules
(a) “Pierre Christophe”, “We”, “Us”, “Our(s)” refers to Pierre Christophe votre conciergerie;
(b) “Member”, “You” and “Your” refers to the customer identified;
(c) “Tasks” refers to our range of work that we carry out for you;
(d) “Service(s)” are the services you have engaged us to undertake on your behalf;
(e) “Customer” refers to any person purchasing services from Pierre Christophe;
(f) “Supplier(s)” are third parties / suppliers We have engaged on Your behalf to carry out Services at Your request and include, the Supplier’s company officers, employees, agents and subcontractors;
(g) “Terms and Conditions” and “Terms & Conditions” refers to these terms and conditions set out in this document as well as any special terms and conditions agreed in writing between Pierre Christophe and the Customers.
1.2 Activation / Registration
By activating your account and using the Pierre Christophe services, you agree to all of the terms and conditions of this document. If you do not agree with any of the terms or conditions contained herein, please contact us immediately. We reserve the right to change, modify, add or remove portions of this Terms & Conditions contained herein at any time. Changes will be periodically made and included in a new Terms & Conditions which will be posted in replacement of the old Terms & Conditions. Your continued use of Pierre Christophe services following the posting of any changes will mean that you have accepted the changes.
As a registered member of Pierre Christophe, you agree to abide by these Terms and Conditions, and when ordering anything from a supplier you agree that these Terms and Conditions shall apply to your order.
1.3 Club Rules
(a) All Membership applications are subject to verification by Pierre Christophe. We will notify you in the event that your Membership application has been accepted or refused;
(b) You are obliged to provide correct personal details when you apply for Pierre Christophe Membership and your failure to do so may invalidate your Membership. Your responsibility to provide accurate information is a continuing obligation and you must notify us in the event that any information provided by you changes;
(c) You agree that you will only use your Pierre Christophe Membership card for the purposes for which it is issued. You must notify Pierre Christophe immediately by e-mail or by phone if it is lost or stolen;
(d) Your Membership is personal to you. You are responsible for ensuring that no one else uses your Membership;
(e) Members are responsible for the actions and behavior of their guests;
(f) Access to and use of the Members section of the Pierre Christophe website is through a combination of user name and password and is reserved exclusively for Members. You are solely responsible for maintaining the confidentiality of your user name and password and you agree to notify us immediately if you believe that there has been any breach of security;
(g) Access to all venues is subjected to availability and any rules and restrictions imposed by the individual establishment and their door policy, therefore can’t be guaranteed. These restrictions are likely to include, but not restricted to:
I. Dress code – dressing as appropriate to the venue;
II. Mixed groups – ensure that your group comprises at least 50% girls. All female groups are normally acceptable;
III. Intoxication – if inebriated you are likely to be refused entry;
IV. Entrance fees – can still apply at some venues;
V. Guest list – should be submitted following the establishment requests.
2 Membership usage and benefits
2.1 Using your Membership
(a) Your personalized Membership card will be mailed to you along with your Welcome Materials maximum 15 business days after joining Pierre Christophe;
(b) Once you have been accepted as a Member you may only submit your requests by telephone, e-mail or through our Website;
(c) Pierre Christophe reserves the right to withdraw any of these services and/or to refuse to supply the services requested;
(d) If Pierre Christophe is unable to deal with any request, we will inform you as soon as practicable;
(e) Suppliers are responsible for providing you with the services, products and benefits you select. Pierre Christophe will communicate with suppliers on your behalf unless it is more appropriate for you to contact the supplier directly.
(f) Suppliers may impose their own terms and conditions and you are required to comply with these.
(g) Should you lose your card or would like one replaced, the charge of the card is 25, 00-€. You may not add additional cards to your account for other users to reap benefits of the cards. There is a maximum of 1 card per membership, unless stipulated otherwise in your membership plan.
2.2 Membership benefits
(a) You are entitled to all of the benefits described on our website once you become a Member. The descriptions of all benefits displayed have been approved by the relevant benefit supplier;
(b) As a Member of Pierre Christophe please note that suppliers of benefits and the benefits themselves are subject to availability and may change from time to time without notice;
(c) We aims to ensure that the benefits remain available at all times and are constantly negotiating new benefits to ensure that you receive maximum use of your Membership. If any of the benefits become unavailable, we will do all we can to ensure that prior commitments are honored to the fullest extent possible, but shall not be responsible for any actions of suppliers outside our actual control.
(d) As a registered member of Pierre Christophe you will get a notification e-mail as soon as you will reach the 90% of usage of your Membership benefits and before the expiring date of your Membership.
3 Payment & Fees
(a) We offer a complimentary initial consultation for new customers;
(b) Membership fees are communicated upon application.
(c) Our services fees will be provided in a quotation to you prior to us carrying out any tasks. These rates will relate to the provision of services by Pierre Christophe only;
(d) We are entitled to vary fee from time to time, all modification will be notified through the newsletter.
(e) Services and products supplied by any supplier will be charged separately.
(f) If you are one of Pierre Christophe founding Members circle then your annual Membership fee is classed as paid in full for all future years.
(a) Pierre Christophe Membership is payable monthly or annually in advance by personal check, money order, Yapital, credit card or direct debit. 3 months is the minimum membership period;
(b) When you register for Pierre Christophe Membership, your credit card or debit card is charged at regular intervals, as determined by you, either monthly, or annually;
(c) All monthly/annual membership packages, a la carte service and hourly services must be paid up front. Once payment is received, we can proceed with the required task;
(d) You will be billed 7 days prior to the beginning of your membership cycle. Please note that your Membership will begin from the date you signed up and not at the beginning or ending of the month;
(e) Please make sure that you provide a credit card or debit card that you plan on keeping, that you have the appropriate billing address information for and that you plan on using for our charges;
(f) If you utilize additional hours over your Membership package, you can either choose to purchase hourly services or upgrade to another package;
(g) From time to time it may become necessary for us to issue a further invoice to you for additional tasks undertaken or services provided, or where there is a variation to the tasks or services set out in the original quotation. If so, payment shall be made within 7 days upon receipt of the invoice;
(h) Travel time is chargeable in accordance with the hourly rate agreed. If our presence is required outside a 35 km radius of the Niederanven office the fee will be agreed on a case by case basis;
(i) If you fail to make payment in accordance with art.3.2 of these Terms & Conditions, we reserve the right to charge interest at a rate of 7% on the outstanding amount as explained on our invoices;
(j) If it becomes necessary for us to commence legal proceedings for any outstanding amounts owed to Pierre Christophe, we will be entitled to be indemnified by you for the full amount of our legal costs.
3.3 Renewals and Upgrades
(a) Membership will continue in perpetuity unless cancelled. Your subscription will renew automatically each month/ year;
(b) Membership are not set to renew at the beginning or ending of each month/ year, rather the begin on the day that you activate your membership;(c) You will not be notified of the renewal. Therefore, you consent and allow Pierre Christophe to charge your card each month/ year without contacting you in any way, unless you notify us differently;
(d) If Pierre Christophe does not hold your payment details you will be contacted directly in order to renew your Membership;
(e) If you do not wish to renew Membership you must notify us 30 days prior to your renewal date;
(f) You can upgrade/ downgrade your account based upon your usage at any time;
(g) In case of upgrade you will pay the portion of the new membership, minus the portion you paid for your lower grade membership;
(h) In case of downgrade the package fee will be modified at the next renewal date available.
4 Cancellation and Refunds
(a) Cancellations of monthly/ annual Memberships are subjected to review ad must be requested in writing 30 days prior to the next billing cycle. Should you cancel at any time after the first day of your renewed membership cycle, you will be billed for that month;
(b) Cancellation of any appointments and booking must be in writing at least 24 hours in advance via email, stating clearly that you wish to cancel;
(c) Cancellation less than 24 hours of any appointments or bookings will be charged from 50% to 100% of the final invoice amount in a case by case basis and will be deducted from your account.
(d) Services canceled without prior notice may result in the full price of service being charged;
(e) Pierre Christophe reserves the absolute right to cancel or suspend your Membership (at its sole discretion) for any reason whatsoever. If Pierre Christophe cancels your Membership, Pierre Christophe may (at its sole discretion) refund the balance of the annual Membership fee on a time apportionment basis in respect of the unexpired period which the Membership fee relates;
(f) For any reason or further instruction on how to cancel your membership please email us;
(g) Your Membership fee is non-refundable. However, we may elect to refund your Membership fee in whole or in part depending on the circumstances relating to the cancellation of any Membership;
(h) For any service or time purchase credits will be refunded only if there was an error committed by a Pierre Christophe consultant.
(i) There will be no refunds for purchases made on your behalf. When you ask for our representatives to make purchases on your behalf, we will not be held accountable should the product or service you are purchasing not meet the expectations you had in mind.
5 Working hours and Distance
5.1 Working hours
We can provide services to you 24/7, however, Pierre Christophe hours are 09:00 to 20:00 (Luxembourg time) Monday through Friday. Services REQUESTED outside of normal business hours and/or on holidays may be subject to additional fees.
Travel time is chargeable in accordance with the hourly rate agreed. If our presence is required outside a 35 km radius of the Niederanven office the fee will be agreed on a case by case basis.
6 Services and Errands
(a) We supply services in four different “sectors”: Jet, Auto, Private and Luxury;
(b) In the event of any inconsistency with any other terms, these Terms & Conditions shall prevail;
(c) We reserve the right to change these Terms & Conditions from time to time and will provide reasonable notice to you;
(d) Nothing in these Terms and Conditions shall affect your statutory rights as a consumer;
(e) Pierre Christophe’s information and suggestions will be based upon specific criteria provided to us, and we will act in accordance with instructions provided by you, and will assume all information provided by you is accurate, true and correct;
(f) Any Service requiring ticket purchases, bookings or reservations will be subject to the terms & conditions of the supplier or operator, to which you agree, upon instructing us, to purchase or book on your behalf;
(g) When engaging our services, you authorize us to debit your payment card for deposit purposes where required;
(h) Whilst all efforts shall be made to ensure products or services purchased from suppliers are bona fide, we shall not be held liable should any product or document (examples include but are not limited to, event tickets or merchandise) purchased by us, for you on your behalf, is subsequently found not to be genuine or is not accepted by another party / supplier;
(i) We will endeavor to source the highest quality products and services (examples include but are not limited to groceries, catering, car valet etc.) possible for your budget at all times, however, we will not be liable for supplier products or services that you deem not acceptable or up to Your standards;
(j) When purchasing tickets, goods or services (examples include but are not limited to restaurants, hotels and tickets) for you, on your behalf, you should expect that all sales are final and no refunds or cancellations will be issued after purchase from the supplier. You will be held responsible for any cancellations you wish to make, or any monies forfeited as a result of cancelling or changing a booking. Should an event be cancelled, We will not be responsible for any loss or damage that you may incur as a result of the event being cancelled;
(k) We reserve the right to refuse any request that we deem inappropriate.
(a) Hourly rate for on-site errand running begins from the time the office in Niederanven is left until the requested task is completed. Mileage over 10 km of travel currently billable at 1, 79-€ per km. (Please note mileage rates are subject to changes);
(b) Errand running services include all personal assistant services that involve personal errand running, on location and cannot be handled over the phone or Internet. For requests beyond what is covered by concierge requests, the charge will be billed hourly or on a per request basis;
(c) Concierge specialists are always based in our home office location in Niederanven but it is not guaranteed that you will speak with or deal with the same concierge consultant each time you place a request, unless stipulated as part of your membership plan. Concierge specialists will do their best possible to provide you with the information or task at hand. However, there will be circumstances where such information or unusual requests are not fulfilled and Pierre Christophe will not be held accountable, liable or financially responsible for any inaccurate information provided.
(a) Every effort will be made to ensure that suppliers put forward by us are qualified, insured, and competent to carry out the services required to a proper standard. However, we shall not be held responsible or liable for products and services carried out by any supplier, including if the supplier products or services fall below standard;
(b) Unless you have requested or agreed to a particular supplier or specific charge for services, we shall make conscious efforts to ensure that the supplier’s charges are reasonable and in keeping with the local market. However, we shall not be held responsible for any supplier charges, whether or not you consider those charges are reasonable, or for any supplier charges for any services negotiated, and agreed, by you direct with the supplier;
(c) Where we engage a supplier on your behalf, we act only in the capacity as an introductory agent. We will endeavor to provide you with supplier Terms & Conditions where available but we are not liable if we do not provide the supplier Terms and Conditions to you;
(d) We accept no liability for any information, material or services provided to you by, or exchanged with, any supplier. Should you contract or decide to contract with any supplier, the contract is strictly between you and the supplier. Any payment or monies required by the supplier is your responsibility and will be paid in accordance with your contract with that supplier;
(f) We accept no liability for any dispute arising from any agreement made between you and any supplier; and you indemnify and release us from liability in relation to any claim, dispute or action arising between you and the supplier;
(g) Complaints regarding a supplier should be made directly to the supplier. We request that we are notified for our records.
8 Customer’s Responsibilities
(a) You undertake that all details you provide to us for the purpose of booking, ordering or purchasing products or services are correct, that the payment method you are using is your own and that there are sufficient funds to cover the cost of the product or the service;
(b) Unless otherwise agreed by the Supplier, you shall not be entitled to cancel any services requested where, on your instructions, performance has already begun;
(c) You shall not use the services for any improper, immoral or unlawful purpose, or for any other purpose other than for which you inform us at the time of the initial request;
(d) In the event that you request that we use your credit card, Yapital and/or other credit facilities in relation to the services, you shall, as soon as reasonably practicable, provide us with a written confirmation authorizing us to use such facilities. you acknowledge and accept that we shall not be liable in any way whatsoever with regards to the use of your credit card/or other credit facilities provided that we act in accordance with your instructions;
(e) You shall cooperate with us and provide us with any information and comply with all requirements, which are requested by us in the quote, or from time to time, that may be reasonably necessary to enable us to perform the services;
(f) You will be responsible for obtaining any consents, licenses and permissions from other parties necessary for services to be provided at your cost, and for providing us and/or the supplier the necessary consents, licenses and permissions.
(g) If the task requested by the client requires access to a business or residence, arrangements must be made to allow Pierre Christophe access to the property. If, for any reason, we cannot gain access, the full charge will be assessed to the client. You may choose an option of a key safe to arrange for service access or arranging for key pick up and drop off if you are not available.
(a) Save in respect of death and personal injury caused by the negligence of Pierre Christophe or as expressly provided for in these Terms and Conditions, we shall not be liable for any loss, cost, expense or damage of any nature whatever (whether direct or indirect) resulting from the provision of services or your reliance upon the information and suggestions provided by us hereunder and the resulting supply of services to you by any third party;
(b) Pierre Christophe shall have no liability to you for any loss, damage, costs, expenses or other claims for compensation arising from requests or instructions supplied by you which are incomplete, incorrect or inaccurate or any other fault of you;
(c) Pierre Christophe shall not be liable to you or be deemed to be in breach of these Terms and Conditions by reason of any delay in performing, or any failure to perform, any of Pierre Christophe ‘s obligations in relation to its services, if the delay or failure was due to any cause beyond ours reasonable control;
(d) Except in respect of death and personal injury and subject to the provisions of these Terms and Conditions, Pierre Christophe’s maximum liability to you for breach of any of its obligations hereunder shall be limited to the value of the annual Membership fee;
(e) We aim to ensure that viruses (or other programs having adverse effects) do not reside on the Site, but we accepts no responsibility in relation to this;
(f) We will not be held accountable, liable or responsible in any way for purchases on your behalf that are lost during shipping, tickets arriving late, goods damaged in the mail, etc;
(g) You agree that any contract entered into by you with any of the suppliers is an independent contract. Pierre Christophe hereby disclaims any and all liability for any act or omission of any supplier or any loss incurred by you as a result of any act or omission of a supplier whether or not arranged through us;
(h) We warrant to you that Pierre Christophe shall use its reasonable endeavors to provide the services with reasonable care and skill and, as far as reasonably possible, in accordance with your request and instructions from time to time. Where Pierre Christophe supplies you with any goods or services supplied by a third party, then we are acting as your agent in sourcing the goods or services. We will use reasonable care in selecting the supplier and ensuring the order is placed in accordance with your wishes;
(i) Pierre Christophe does not and will not provide any representations or recommendations in relation to any of the information and suggestions comprised within the services. You are deemed to be responsible for, and shall use your own skill and judgment as to, the quality, value and suitability of such information and suggestions in relation to deciding whether to enter into any contract with any third party for the supply of services or sale of goods;
(j) This section applies only to the extent permitted by law.
1. By agreeing to our terms, you realize that there are inherent limitations to the services we are to provide. We will not make illegal purchases on your behalf or represent you in any unlawful or illegal way. We will take all the precautions necessary to protect your information, but we will not be held responsible or accountable or liable for any reason whatsoever should your information become exposed or if you are not pleased with the products or services you approved for us to charge on your behalf. Ours operators will also not lie on your behalf for any reason or be involved or responsible for any of your personal, business, financial or other actions. Ours operators will not honor fraudulent outbound calling, money collections, prank calling or other illegal activities. Pierre Christophe holds the right to refuse any business it feels is unsafe and unsuitable for its employees.
11 Insurance and Force Majeure
(a) It is your responsibility to decide whether insurance is required in relation to a service, and which insurance cover is appropriate, and we shall not be held liable or responsible for any loss or damage incurred as a result of you choosing the incorrect insurance cover, or for any other reason;
(b) Neither party shall be in breach of its obligations, or incur any liability, to the other party if the failure to perform its obligations is a result of a force majeure event including, but not limited to, acts of God, terrorism, accidents, war, labor disputes or strikes;
(c) The party affected by the force majeure event shall, as soon as reasonably practicable, provide notice of the force majeure event to the other party. The parties shall resume the normal performance of the agreement as soon as reasonably practicable and the party affected by the force majeure event shall be entitled to a reasonable extension of time to perform its obligations.
12 Changes to Club rules
(a) We may vary these Terms and Conditions and the Club rules from time to time and will notify you of any changes in a timely manner. Notification will be by some or all of the following medium:
I Our newsletter;
II The website;
IV Mail or other personal delivery service;
V The national press.
(b) Your continued use of your Membership constitutes acceptance of the altered Terms and Conditions or Club rules.
13 Copyright and Plagiarism
Pierre Christophe owns or is lawfully entitled to all of the copyright in this website. All other intellectual property rights are reserved. This website is for your personal use only – you may not use it for commercial purposes. You may only download to your personal computer for viewing purposes and print out a number of pages of this website for your personal use. You may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer or sell any information obtained from this website. This applies to all non-members, including anyone who visits this website.
14 Law and Jurisdiction
These Terms and Conditions and your Membership with Pierre Christophe are governed by the laws of Grand Duchy of Luxembourg and are subject to the exclusive jurisdiction of the courts of Grand Duchy of Luxembourg. We will endeavor to resolve all disputes that may arise through amicable negotiations. All disputes to which this Terms & Conditions could give place concerning its validity, its interpretation, its execution or its termination, and which could not lead in a mutual agreement will be, insofar as permitted by law, submitted to the competent court.
